Spanish tax reclaim in a nutshell
From 1997 until the end of 2006, the Spanish Tax Office charged non-residents of Spain a higher rate of capital gains tax when they sold their properties than local residents had to pay.
This was clearly a case of discrimination, so the Spanish Government was taken to the European Court.
And they lost.
That means that every foreign non-resident taxed on the sale of their property from 1997 to the end of 2006 qualifies for a tax rebate.
